1. Acceptance of Terms
By accessing or using Zorq AI ("Service"), operated by Zorqai AB, a company registered in Sweden ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Service Description
Zorq AI is an AI-powered platform that enables users to generate images, videos, and audio content using various third-party AI models. The Service includes features such as:
- AI image generation (text-to-image, image-to-image)
- AI video generation (text-to-video, image-to-video, video editing)
- AI audio generation (text-to-speech, voice cloning)
- Multi-generation tools for batch processing
- AI Influencer and identity-based image generation
- A personal gallery for managing generated content
3. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Be responsible for all activity under your account
- Notify us immediately of any unauthorized use
You must be at least 18 years of age to create an account and use the Service.
4. Credits and Payments
The Service operates on a credit-based system. Credits are required to generate content.
- Purchasing credits: Credits can be purchased as one-time top-ups or through subscription plans via our payment processor, Whop.
- Credit usage: Different generation types and AI models consume different amounts of credits, as displayed in the Service at the time of generation.
- No transfer: Credits are non-transferable and tied to your account.
- Expiration: Credits do not expire as long as your account remains active.
- Subscriptions: Subscription plans automatically renew at the end of each billing period unless canceled before the renewal date. Cancellation takes effect at the end of the current billing period.
- One-click offers: After a purchase we may show you a one-time discounted offer to move to a larger plan. That offer has no separate checkout page: the button states the amount charged today and the price it renews at, and pressing it authorizes us to charge the payment method you have stored with Whop immediately, for the amount shown. Nothing is charged unless you press it, the discount applies to the first payment only, and the plan renews at the stated price until you cancel.
- Plan changes: You can move to a larger plan at any time. Moving to a smaller plan, or from yearly to monthly billing, is not available while a subscription is running — cancel first, keep what you paid for until the period ends, and choose a smaller plan after that.
All payments are processed securely through Whop, Inc. We do not store your payment card details. By making a purchase, you agree to Whop's terms and conditions.
5. User Content
Your inputs: You retain ownership of any text prompts, images, or other materials you provide to the Service ("Input Content"). You are solely responsible for ensuring you have the necessary rights to use any Input Content.
Generated output: Subject to these Terms and applicable law, you may use AI-generated content ("Output Content") for personal and commercial purposes. You acknowledge that:
- AI-generated content may not be eligible for copyright protection in all jurisdictions
- Other users may generate similar or identical output from similar prompts
- We do not guarantee exclusivity of any generated content
License to us: By uploading Input Content, you grant us a non-exclusive, worldwide license to process and use that content solely for the purpose of providing the Service to you (e.g., sending it to AI model providers for generation). We do not use your content to train our own AI models.
Prompt text: You also grant us a perpetual, worldwide, royalty-free licence to use the text prompts you write — to improve the Service, and to include them in prompt libraries, templates, tutorials and marketing materials. Where a prompt identifies a real person or contains other personal details, we edit those out before any public use.
This licence covers prompt text only. It does not extend to images, video or audio you upload, nor to the content you generate. Those remain yours, and we do not publish them without asking you first — for example through the sharing option in the Community, where you choose what to share and grant that permission yourself.
Prompts written in Business Studio are excluded from this licence and are never reused.
6. Prohibited Use
There is no tolerance for objectionable content or abusive behaviour. By using the Service — and in particular by sharing anything to the Community — you agree that content which is objectionable, abusive, or otherwise in breach of this section may be removed without notice, and that accounts posting it may be suspended or terminated. Reported content is reviewed and acted on, normally within 24 hours. Anyone can report a post from the Community, and block the account that posted it, from inside the app.
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
- Create deepfakes or misleading content intended to deceive or harm others
- Generate content depicting minors in any inappropriate context
- Upload or use images of real people without their explicit consent
- Infringe upon intellectual property rights of any third party
- Attempt to reverse-engineer, decompile, or extract the underlying AI models
- Circumvent credit requirements, usage limits, or other technical restrictions
- Use automated tools, bots, scripts, or browser automation (e.g., Selenium, Puppeteer) to access the Service, generate content, or perform any actions — except through our official API and MCP integrations
- Resell or redistribute access to the Service without authorization
- Use the Service to develop competing products or services
7. Third-Party AI Models
The Service integrates third-party AI models from various providers. These models are provided "as is" and may be updated, changed, or discontinued by their respective providers at any time. We do not control the underlying AI models and cannot guarantee specific results, availability, or performance.
8. Content Moderation
We reserve the right to review, remove, or restrict access to any content generated through or uploaded to the Service that violates these Terms or applicable law. We may also suspend or terminate accounts that repeatedly violate our policies.
9. Affiliate Program
Zorq AI offers an affiliate program that allows users to earn commissions by referring new paying customers. Participation is subject to the following:
- Commissions are earned on qualifying purchases made by referred users
- Earnings are subject to a holdback period before becoming available for payout
- We reserve the right to modify commission rates, terms, or discontinue the program at any time
- Fraudulent referrals, self-referrals, or manipulation of the program will result in forfeiture of earnings and account termination
10. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Generated content will meet your requirements or expectations
- Any defects will be corrected
- The results of using the Service will be accurate or reliable
11. Limitation of Liability
To the maximum extent permitted by law, Zorq AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (i) the amount you paid to us during the three (3) months preceding the claim, or (ii) one hundred US dollars ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Zorq AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
13. Account Termination
We may suspend or terminate your account at any time, with or without notice, if:
- You violate these Terms
- Your use of the Service poses a risk to other users or our operations
- We detect automated, scripted, or bot-driven usage of your account
- Required by law or a legal proceeding
You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Any unused credits are forfeited upon account termination for cause. No refund will be issued for accounts terminated due to violation of these Terms, including but not limited to automated or abusive usage.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Sweden.
